Sentencing of Barbie Kardashian for threats to rape and kill mother adjourned as psychological report not available

SENTENCING of a woman who threatened to torture, rape, and kill her mother was today adjourned for a second time as a pre-sentencing psychological report on the defendant was not available.

Limerick Circuit Court Judge Tom Oโ€™Donnell, presiding, previously described a finalised probation report on the accused, Barbie Kardashian, as โ€œdeeply disturbingโ€.

Ms Kardashianโ€™s barrister Mark Nicholas told the first sentencing hearing last July that Kardashian was being assessed for a โ€œcomplex psychological issueโ€ and that the report was not finalised.

Judge Oโ€™Donnell told the July hearing that he considered the finalised probation report as โ€œvery seriousโ€ and โ€œdeeply disturbingโ€ and that he expected that a finalised psychological report would be made available to the court within seven weeks.

However, today, Judge Oโ€™Donnell was informed by prosecuting counsel, John Oโ€™Sullivan, BL, that the psychological report was not yet available and Mr Oโ€™Sullivan advised the judge that sentencing could not proceed without it.

Kardashian (20), of no fixed abode, is being held in custody at the female wing of Limerick Prison, having previously been granted a certificate from the Department of Social Protection recognising her gender as female.

Kardashian was convicted by a jury last May of seven counts of threatening to kill her mother, Maria Luque, on dates in 2020.

The 20-year old was found not guilty of four other counts of threatening to kill social care worker Michael Mannix between 2019 and 2020.

All of the threats were made when Kardashian was a resident at Coovagh House, a secure unit for 11-17 year olds with severe psychological issues, the jury heard.

During the four-day trial, Mr Nicholas said he accepted that Kardashian told Coovagh House staff, during a planned meeting to discuss her impending discharge into the community, that she was planning on traveling to her motherโ€™s house to overpower her and torture her with a knife, a screwdriver, and boiling water.

Kardashian told senior staff that she planned to only leave her motherโ€™s house once she was satisfied she had left her to โ€œbleed outโ€, adding that she would make sure to check her motherโ€™s pulse to ensure she was dead.

Mr Nicholas argued that Kardashianโ€™s threats were simply fantasy and that her former social care workers did not immediately alert Gardaรญ about the threats, having dismissed them as being brought on by Ms Kardashianโ€™s previous diagnosis of narcissistic personality disorder.

Coovagh staff, including Michael Mannix, agreed under cross examination that Ms Kardashian often engaged in shock behaviour in order to get attention.

Kardashian had experienced a โ€œhorribleโ€ life, said Mr Nicholas, and had been in State care since she was 10 years old.

In his sum up to the jury, Mr Nicolas said there had been an โ€œabsence of alarmโ€ in Coovagh House until it was time for Ms Kardashian to be released into the community, almost two years after she made the first alleged threat to kill Mr Mannix.

There were only fifteen available beds within the State for minors who were considered a risk of being a danger to themselves or to others, Mr Nicholas told the court.

Today, Judge Oโ€™Donnell remanded Kardashian in continuing custody in Limerick Prison for sentencing on March 16, 2023, when it is anticipated the psychological report will have been made available to the court.
