THE assault of a woman was captured on a phone video, a court has heard. 27-year-old Erica Landers with an address at Silverbrook, Corbally, was before the court answering bail on a Section 3 assault charge dating back to October 19 last year. The court heard that the accused was involved in an altercation outside her home and that the incident was recorded on mobile phone.
Images captured in the footage showed the accused woman on top of the injured party where she was seen slamming the other person’s head to the ground repeatedly.
She was also seen standing over the injured party.
The court heard that the injured party had received fracture wounds to her hand and fingers.
John Devane, solicitor, told the court that the injured party was from another locality and “had no business in the Silverbrook area at the time, other than to confront his client.
The court heard from Mr Devane that his client’s house had been targeted on a number of occasions in the past but he was not linking the injured party to these incidents.
Erica Landers, it was said, was defending herself and protecting her own house but he agreed that she did step over the line.
With 67 previous convictions, one of which included assault, Ms Landers was said to be “very afraid to go to prison” as she believed she would return to find her house burnt down.
He added that Ms Landers lives her life in daily fear but Judge Eamon O’Brien said that “we all have to operate within the law”.
Erica Landers was sentenced to nine months in prison but Judge O’Brien suspended it for a period of two years.
