Found guilty of thefts at fishmongers

A 48-year-old woman, with over 23 years employment at Rene Cusacks Fishmongers, has been found guilty of stealing property from Paul Cusack on three separate occasions.  Judge Tom O’Donnell gave his deliberations and guilty verdict after the original charges against Josephine Garvey, Islanduane, Mungret, were before the court last week.

 

Ms Garvey, who was employed to look after debtors control with access to cash, cheques and lodgements at Rene Cusacks, was accused of stealing money on May 25, June 15 and 18, 2009 at Raheen Industrial Estate. The amounts were €50, €130 and €40 respectively.

The charges were brought against Ms Garvey, a married mother of four, after a complaint was made to gardai by John Sheehan, a company director, that money was missing and not being accounted for through the company accounts.
Ms Garvey was questioned, interviewed and shown images as well as CCTV footage of the three alleged incidents. In her defence, she offered explanations that the €50 was for lotto money, that she was owed the €40 and the €130 was given to another unnamed co worker.

Judge O’Donnell said that he did not find acceptable the evidence or explanations offered by the accused and that she was an active participant in the “enterprise” and found her guilty on all three counts before the court.
Josephine Garvey, who was described in court as “a pillar of the community” by her solicitor Pat Barriscale, and a woman with no previous convictions, was convicted of the charge relating to June 15, 2009 and fined €500 by Judge O’Donnell and given six months to pay. The other two charges were taken into consideration.
