TWO former employees of a Limerick fishmonger are to be sent for trial at Limerick Circuit Criminal Court to face charges of theft from their employer. 50-year-old, Seamus Mahon, 49 Griffith Avenue, Ballinacurra Weston, and 48-year-old Dermot Fitzgerald, with an address at 38 Cluain Dara, Clonmacken, were in court to face additional charges of theft and have the book of evidence served on them by Garda Michael Conroy, of the Divisional Crime Scene Investigation Unit.
Mahon and Fitzgerald, along with two others who are also before the courts, are charged with seven counts of theft of various amounts from Rene Cusack’s fish premises between May and June of last year. Both Mahon and Fitzgerald have pleaded not guilty to the charges and have been sent forward for trial to the Circuit Court pursuant to the legislation outlined in the Criminal Procedure Act.
Both were in court with their solicitor, Dan O’Gorman, where they received the alibi warning from Judge Tom O’Donnell.
The court heard that the DPP had consented to the two men to the sent forward for trial and Judge O’Donnell extended their conditions of bail. Both were placed on their own bonds of €150, and the case was adjourned.
