ANTHONY Kelly, brother to the late Alderman Michael Kelly, who was charged last week with the alleged possession of a hand gun with the intent to danger life, has been granted bail by a sitting of Limerick District Court this week. Following garda submission regarding an objection to bail on the grounds of the seriousness of the charge and the possibility that on conviction a mandatory 10 year sentence could be imposed, detective garda Pat Whelan took the stand and outlined the concerns of the gardai.
However, solicitor for the accused, John Devane, came on record for his client and outlined that Mr Kelly would obey any bail conditions imposed by the court and the gardai and that Anthony Kelly had “no problem in doing so”.
Mr Devane also outlined that a brother of Anthony Kelly was in a position to submit monies or stand as “bails man for his brother” as he received a substantial redundancy package from his employment at Dell.
Kelly was charged following an alleged incident last week where a man was injured near Mr Kelly’s home in O’Malley Park on October 28 last.
Granting bail under certain terms and conditions, Judge O’Donnell ordered that 49-year-old Anthony Kelly, of 121 O’Malley Par, reside at his home, obey a curfew and surrender his passport to the state. The accused had to submit his own bond of €1000 and an independent surety of €10,000.
Kelly was remanded in custody with consent to bail to appear before the court on November 12 next.
The injured man, 27-year-old Michael Lynch, was recovering and in a stable in hospital following the shooting.
